Acceptance of User Terms. When User uses the\u00a0Services,\u00a0User agrees to these\u00a0User Terms\u00a0and to any other applicable\u00a0Seensio Terms\u00a0found in the Seensio Legal Terms. User may not agree to these\u00a0User Terms\u00a0or any other\u00a0Seensio Terms\u00a0if User is not legally allowed to, or if User is under 18 years old.\u00a0Users\u00a0under the age of 18 (\u201c<\/span><b>Minor\u00a0Users<\/b><span style=\"font-weight: 400;\">\u201d) require a parent or legal guardian (a \u201c<\/span><b>Guardian<\/b><span style=\"font-weight: 400;\">\u201d) to allow them to use the\u00a0Services\u00a0and to agree to these\u00a0User Terms\u00a0and the other applicable\u00a0Seensio Terms. By permitting a\u00a0Minor User\u00a0to use the\u00a0Services,\u00a0the\u00a0Guardian\u00a0of the Minor User becomes subject to these\u00a0User Terms\u00a0and any other applicable\u00a0Seensio Terms\u00a0and agrees to be responsible for the\u00a0Minor User\u2019s activities on the\u00a0Services. If User (or a\u00a0Minor User\u2019s\u00a0Guardian, as may be applicable) doesn\u2019t agree to these\u00a0User Terms\u00a0or any other\u00a0Seensio Terms, User may not use the\u00a0Services.<\/span><\/span><\/p>\n<p><span style=\"font-size: 14px; color: #666666;\"><span style=\"font-weight: 400;\">2.2. Changes to Terms. jK will provide User with reasonable advance notice of any material updates or modifications to these\u00a0User Terms\u00a0and any other\u00a0Seensio Terms\u00a0(which, notice may, (i) for\u00a0Users, be provided by any reasonable means of notification, including by email or via posting on the Seensio website,\u00a0<\/span><span style=\"color: #00ccff;\"><a style=\"color: #00ccff;\" href=\"https:\/\/seens.io\/en\/\"><span style=\"font-weight: 400;\">www.seens.io<\/span><\/a><\/span><span style=\"font-weight: 400;\">), provided that non-material changes (as determined by Seensio) or updates or modifications that address new features of the\u00a0Services\u00a0or modifications or updates made for legal reasons will be deemed to be effective immediately and without notice. If User does not agree to any modifications or updates to these\u00a0User Terms\u00a0or any other\u00a0Seensio Terms, User should no longer use the\u00a0Services. If User uses the\u00a0Services\u00a0after Seensio has posted updates to these\u00a0User Terms\u00a0or other\u00a0Seensio Terms, User is agreeing to the updated\u00a0User Terms\u00a0and other\u00a0Seensio Terms. Any\u00a0Dispute\u00a0covered by these\u00a0User Terms\u00a0or any other\u00a0Seensio Terms\u00a0will be handled in accordance with\u00a0Section 16\u00a0of these\u00a0User TermsTerms applicable to all Users which provide an overview and the associated rules for things like (i) account creation, (ii) using Seensio to make purchases, (iii) trading Virtual Items, and (iv) activities prohibited on the Platform. The User Terms also cover some of the more technical legal terms that govern use of the Services, including intellectual property ownership, online safety, disclaimers and other very important legal terms.<\/span><\/span><\/p>\n<p><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">2.3. Updates to the Services. jK has the right to change or suspend the\u00a0Services\u00a0(or any portion thereof) at any time upon notice, which may be via an email to User or through a notice on the Seensio website (and such notice shall be effective immediately after such email is sent or such notice is posted) and without liability to\u00a0Users. jK can change the\u00a0Services\u00a0for any reason, including to comply with law, to protect\u00a0Users\u00a0or to protect Seensio\u2019s reputation. These\u00a0User Terms\u00a0and any other applicable\u00a0Seensio Terms\u00a0will govern any updates to the\u00a0Services\u00a0that Seensio makes or provides to User, unless the update includes a separate license, in which case the terms of that license will govern.<\/span><\/p>\n<p><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">2.4. Termination of User Terms. In the event of termination of these\u00a0User Terms\u00a0or any other\u00a0Seensio Terms, the rights and duties of Seensio and User to each other will terminate except that all provisions of these\u00a0User Terms\u00a0or any other\u00a0Seensio Terms\u00a0which are to survive expiration or termination will remain in effect.<\/span><\/p>\n<\/div><\/div><div  class=\"vc_toggle vc_toggle_simple vc_toggle_color_default  vc_toggle_size_sm\"><div class=\"vc_toggle_title\"><h3 style=\"font-size: 16px;color: #666666;text-align: left\" class=\"vc_custom_heading\"  >3. User Accounts<\/h3><i class=\"vc_toggle_icon\"><\/i><\/div><div class=\"vc_toggle_content\"><p><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">3.1. Creating an Account. To access some elements of the\u00a0Services,\u00a0Users\u00a0need to create a Seensio account (\u201cAccount\u201d). User agrees to always provide Seensio with true information and to keep that information updated. Remember, Seensio may take steps to make sure that the information\u00a0Users\u00a0give Seensio is accurate. A User may never allow anyone else to use a User\u2019s\u00a0Account\u00a0(except for\u00a0Guardians in the case of a\u00a0Minor User). If a User thinks that their\u00a0Account\u00a0is not secure, User must tell Seensio immediately by contacting\u00a0Seensio Support. If anyone asks for a User\u2019s password or personal information, User should report them right away.<\/span><\/p>\n<p><span style=\"font-size: 14px; color: #666666;\"><span style=\"font-weight: 400;\">3.2. Account Suspension or Termination. \u00a0If User violates these\u00a0User Terms\u00a0or any other applicable\u00a0Seensio Terms, User\u2019s right to use the\u00a0Services\u00a0ends. In response to a violation of these\u00a0User Terms\u00a0(or other applicable Seensio Terms) by a User, Seensio may also (i) suspend or terminate a User\u00a0Account\u00a0or a User\u2019s access to the\u00a0Services, or (ii) remove any\u00a0Virtual Items\u00a0or other content that the User has on the\u00a0Services. Seensio may also terminate a User\u00a0Account\u00a0pursuant to its policy of terminating in appropriate circumstances\u00a0Users\u00a0who Seensio determines, in its sole discretion, are repeat infringers as contemplated by the Digital Millennium Copyright Act.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">Notification and Appeal. Seensio may notify User if Seensio (i) suspends or terminates a User Account or a User\u2019s access to the Services or (ii) removes Virtual Items or other content that the User has on the Services in violation of these\u00a0User Terms,\u00a0any other applicable Seensio Terms, in response to law enforcement requests, or as otherwise required by law. Seensio may provide users with an opportunity to request another review of Seensio\u2019s decision. Users in violation of these User Terms or any other applicable Seensio Terms will not be entitled to anything from Seensio \u2013 so all\u00a0Users\u00a0should make sure to follow the rules! For any\u00a0Minor Users, a\u00a0Guardian\u00a0may ask Seensio to terminate the\u00a0Minor Users\u00a0Account\u00a0by contacting\u00a0Seensio Support.<\/span><\/span><\/p>\n<\/div><\/div><div  class=\"vc_toggle vc_toggle_simple vc_toggle_color_default  vc_toggle_size_sm\"><div class=\"vc_toggle_title\"><h3 style=\"font-size: 16px;color: #666666;text-align: left\" class=\"vc_custom_heading\"  >4. Restrictions on the Use of Services<\/h3><i class=\"vc_toggle_icon\"><\/i><\/div><div class=\"vc_toggle_content\"><p><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">4.1. In addition to any other restrictions set forth in these\u00a0User Terms\u00a0or any other\u00a0Seensio Terms,\u00a0Users\u00a0may not (a) lease, lend, sell, redistribute or sublicense any part of the\u00a0Services, (b) copy, modify, distribute, publicly perform or display, reverse engineer, disassemble, modify, or create derivative works of the\u00a0Services\u00a0or related or implemented technology, (c) try to get around any technological measure designed to protect the\u00a0Services\u00a0or any technology associated with the\u00a0Services, (d) reverse engineer, disassemble, decompile, decode, adapt, or otherwise attempt to derive or gain access to any\u00a0Services\u00a0source code, in whole or in part (unless a portion of code contained within the\u00a0Services\u00a0is released as open source and the open source license governing such code expressly permits reverse engineering, copying or other modification), (e) use the\u00a0Services\u00a0to create malicious or abusive content (as determined by Seensio) or any content that violates a Seensio guideline or policy; or (f) use the\u00a0Services\u00a0(or any part thereof or any technology contained therein) in any manner that infringes, misappropriates, or otherwise violates any intellectual property right or other right of any person, or that violates any applicable laws.<\/span><\/p>\n<\/div><\/div><div  class=\"vc_toggle vc_toggle_simple vc_toggle_color_default  vc_toggle_size_sm\"><div class=\"vc_toggle_title\"><h3 style=\"font-size: 16px;color: #666666;text-align: left\" class=\"vc_custom_heading\"  >5. Disputes between Users and Creators or Between Creators<\/h3><i class=\"vc_toggle_icon\"><\/i><\/div><div class=\"vc_toggle_content\"><p><span style=\"font-size: 14px; color: #666666;\">5.1. Disputes between User and Creators. If a User has any issues with Experiences, Virtual Items, or other UGC created by Creators, User should first contact the Creator directly to resolve the issue,<\/span><\/p>\n<p><span style=\"font-size: 14px; color: #666666;\">5.2. Escalation to Seensio. While Seensio is not responsible for these types of issues between\u00a0Users\u00a0and\u00a0Creators, Seensio wants to make sure that everyone enjoys the\u00a0Platform\u00a0and\u00a0Services. As a result, Seensio has the right (but not obligation) to intervene in issues between\u00a0Users\u00a0and\u00a0Creators\u00a0so that Seensio can try to help resolve them. Before escalating any issues between a User and Creator to Seensio,\u00a0Users\u00a0should first make a real, genuine effort to work out a solution with the Creator. If User does not succeed, User may escalate the issue to Seensio\u2019s Customer Service team by completing the form at\u00a0Seensio support website. If Seensio chooses to take action in any dispute between a User and Creator, User and Creator agree that Seensio\u2019s decision is final and Creator and User will accept that decision. User agrees to work with Seensio in a timely manner to resolve all such issues, and failure to do so is a violation of these\u00a0User Terms.<\/span><\/p>\n<p><span style=\"font-size: 14px; color: #666666;\">5.3. User-to-User Copying Complaint Process. \u00a0As explained in Seensio\u2019s\u00a0Creator Terms, Seensio generally prohibits copying another User\u2019s\u00a0UGC\u00a0and passing it off as a User\u2019s own work. A User (the Complainant) who believes that another User or Creator has improperly copied original material previously uploaded by the Complainant to Seensio, in violation of Seensio\u2019s Terms, may file a complaint using Seensio\u2019s User-to-User Copying Complaint Process. A complaint may be filed by emailing Email Seensio, identifying the copied material, the original work, and any other relevant details. If necessary, Seensio will investigate the complaint and reach a decision as to whether copying in violation of Seensio\u2019s Terms has occurred. If a violation is found, Seensio may take other actions, which may include removal of copied material or termination of a User\u2019s account. A User or Creator who is unhappy with Seensio\u2019s determination may appeal by first requesting and then completing an appeal form and submitting it to Seensio via email by following the instructions on the form. The form may be requested by sending an email to Email Seensio with the heading \u201cRequest Appeal Form.\u201d Users agree that any decision by Seensio on appeal is final and binding.<\/span><\/p>\n<p><span style=\"font-size: 14px; color: #666666;\">5.4. Exclusivity of User-to-User Copying Complaint Process. Any User or Creator who is complaining that another User or Creator improperly copied\u00a0UGC\u00a0previously uploaded to Seensio is required to use the User-to-User Copying Complaint Process and not any other form of complaint. This means that a Complainant is prohibited from engaging in any form of harassment, as well as from filing a DMCA complaint regarding\u00a0UGC\u00a0that a User previously uploaded to the\u00a0Services\u00a0and which the User believes is being improperly copied by another User or Creator on the\u00a0Services. Failure to use the User-to-User Copying Complaint Process when required is a violation of these Terms. Corporate entities (and those acting on behalf of a corporate entity) may, but are not required to, use the User-to-User Copying Complaint Process.<\/span><\/p>\n<\/div><\/div><div  class=\"vc_toggle vc_toggle_simple vc_toggle_color_default  vc_toggle_size_sm\"><div class=\"vc_toggle_title\"><h3 style=\"font-size: 16px;color: #666666;text-align: left\" class=\"vc_custom_heading\"  >6. License to the Services<\/h3><i class=\"vc_toggle_icon\"><\/i><\/div><div class=\"vc_toggle_content\"><p><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">6.1. Subject to\u00a0Users\u00a0compliance with these\u00a0User Terms\u00a0and any other\u00a0Seensio Terms, Seensio grants User a non-exclusive, limited, revocable, non-transferable license to use the\u00a0Services\u00a0on devices that User owns or controls for User\u2019s personal, entertainment use, including the right to download and use, in connection with the\u00a0Services, software that Seensio makes available for download as part of the\u00a0Services, in object code form only.<\/span><\/p>\n<\/div><\/div><div  class=\"vc_toggle vc_toggle_simple vc_toggle_color_default  vc_toggle_size_sm\"><div class=\"vc_toggle_title\"><h3 style=\"font-size: 16px;color: #666666;text-align: left\" class=\"vc_custom_heading\"  >7. Ownership of Seensio IP\/UGC created within an Experience<\/h3><i class=\"vc_toggle_icon\"><\/i><\/div><div class=\"vc_toggle_content\"><p><span style=\"font-size: 14px; color: #666666;\"><span style=\"font-weight: 400;\">7.1. The interfaces, graphics, trademarks, design, information, artwork, data, code, products, software, and all other elements of the\u00a0Services, including the rights therein and any derivatives, (the \u201c<\/span><b>Seensio Intellectual Property<\/b><span style=\"font-weight: 400;\">\u201d or \u201c<\/span><b>Seensio IP<\/b><span style=\"font-weight: 400;\">\u201d) are protected by law. All\u00a0Seensio IP\u00a0is the property of Seensio and Seensio\u2019s licensors.\u00a0Seensio IP\u00a0includes\u00a0UGC\u00a0licensed to Seensio by\u00a0Creators\u00a0under the\u00a0Creator Terms. Except as allowed in these\u00a0User Terms\u00a0or any other Seensio Terms, User may not use any\u00a0Seensio IP\u00a0contained in the\u00a0Services\u00a0unless User gets separate permission from the owner. Seensio reserves all rights to the\u00a0Seensio IP\u00a0not granted in these\u00a0User Terms\u00a0or elsewhere in the\u00a0Seensio Terms. Some\u00a0Experiences\u00a0also allow for independent\u00a0UGC\u00a0creation within the Experience by\u00a0Users\u00a0of that Experience. Such\u00a0Users\u00a0who separately create\u00a0UGC\u00a0within an Experience hereby grant both Seensio and the Creator of the applicable Experience a worldwide, perpetual, royalty-free and irrevocable right and non-exclusive license to use and exploit that\u00a0UGC\u00a0in any manner or media without any obligation, including any obligation to pay royalties or other compensation to any person or party. If such\u00a0Users\u00a0create a Modified Model (defined below), the User hereby assigns all rights, titles, and interests in that Modified Model to Seensio; Seensio in turn grants a non-exclusive license to both User and Creator to use and exploit that Modified Model within the Platform without any obligation (except those otherwise specified in these Terms of Use), including any obligation to pay royalties or other compensation to any person.<\/span><\/span><\/p>\n<\/div><\/div><div  class=\"vc_toggle vc_toggle_simple vc_toggle_color_default  vc_toggle_size_sm\"><div class=\"vc_toggle_title\"><h3 style=\"font-size: 16px;color: #666666;text-align: left\" class=\"vc_custom_heading\"  >8. Online Safety<\/h3><i class=\"vc_toggle_icon\"><\/i><\/div><div class=\"vc_toggle_content\"><p><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">8.1. Seensio cares about the safety of\u00a0Users. If User sees any content or materials on the\u00a0Services\u00a0that appears to recruit, entice, advertise, or solicit any person to perform a sexual or violent act, please use the\u00a0Customer Support Form\u00a0and select the User Safety Concern help category to immediately report the User and situation.<\/span><\/p>\n<\/div><\/div><div  class=\"vc_toggle vc_toggle_simple vc_toggle_color_default  vc_toggle_size_sm\"><div class=\"vc_toggle_title\"><h3 style=\"font-size: 16px;color: #666666;text-align: left\" class=\"vc_custom_heading\"  >10. Disclaimers; No Warranties<\/h3><i class=\"vc_toggle_icon\"><\/i><\/div><div class=\"vc_toggle_content\"><p><span style=\"font-size: 14px; color: #666666;\"><span style=\"font-weight: 400;\">9.1. <\/span><b>UGC\u00a0Disclaimer.<\/b><span style=\"font-weight: 400;\">\u00a0Except as may be required by applicable law, Seensio is not liable for, nor is Seensio obligated to screen, approve, edit or control,\u00a0UGC\u00a0that\u00a0Creators\u00a0or others upload or otherwise make available on the\u00a0Services. Seensio may, however, at any time and without notice, and without any obligation to User, remove, edit, or block or suspend the availability of any\u00a0UGC\u00a0that Seensio thinks violates the Seensio Terms or is otherwise objectionable. User understands that when using the\u00a0Services, User will see\u00a0UGC\u00a0from a variety of sources and understands that\u00a0UGC\u00a0could be inaccurate, offensive, or objectionable. User agrees to waive, and does waive, any legal or equitable right or remedy that User has or may have against Seensio regarding\u00a0UGC. If notified by a User or content owner that\u00a0UGC\u00a0allegedly violates the\u00a0Seensio Terms, Seensio may investigate and decide whether to remove the\u00a0UGC\u00a0(which Seensio can do at any time, without notice).<\/span><\/span><\/p>\n<p><span style=\"font-size: 14px; color: #666666;\"><span style=\"font-weight: 400;\">9.2. <\/span><b>\u201cAs Is.\u201d<\/b><span style=\"font-weight: 400;\">\u00a0THE SERVICES AND ALL MATERIALS AND CONTENT AVAILABLE THROUGH THE SERVICES ARE PROVIDED \u201cAS IS\u201d AND ON AN \u201cAS AVAILABLE\u201d BASIS, WITHOUT WARRANTY OR CONDITION OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SEENSIO AND SEENSIO\u2019S OFFICERS, DIRECTORS, EMPLOYEES, CONSULTANTS, AFFILIATES, INVESTORS, BUSINESS PARTNERS, SUBSIDIARIES AND AGENTS (TOGETHER, THE \u201cAFFILIATED PARTIES\u201d) DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, RELATING TO THE SERVICES AND ALL MATERIALS AND CONTENT AVAILABLE THROUGH THE SERVICES, INCLUDING: (A) ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, OR NON-INFRINGEMENT; AND (B) ANY WARRANTY ARISING OUT OF COURSE OF DEALING, USAGE, OR TRADE. THE\u00a0AFFILIATED PARTIES\u00a0DO NOT WARRANT THAT THE SERVICES OR ANY PART OF THE SERVICES, OR ANY MATERIALS OR CONTENT OFFERED THROUGH THE SERVICES, INCLUDING, WITHOUT LIMITATION, ANY TRANSLATIONS OF CONTENT, WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS, AND DO NOT WARRANT THAT ANY OF THOSE ISSUES WILL BE CORRECTED.<\/span><\/span><\/p>\n<p><span style=\"font-size: 14px; color: #666666;\"><span style=\"font-weight: 400;\">9.3. <\/span><b>No Responsibility.<\/b><span style=\"font-weight: 400;\">\u00a0NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY USER FROM SEENSIO OR ANY MATERIALS OR CONTENT AVAILABLE THROUGH THE SERVICES WILL CREATE ANY WARRANTY REGARDING ANY OF THE AFFILIATED PARTIES OR SEENSIO THAT IS NOT EXPRESSLY STATED IN THE\u00a0SEENSIO TERMS. USER ASSUMES ALL RISK FOR ANY DAMAGE THAT MAY RESULT FROM USER\u2019S USE OF OR ACCESS TO THE SERVICES, USER\u2019S DEALING WITH ANY OTHER USERS ON THE SERVICES, AND ANY MATERIALS OR CONTENT AVAILABLE THROUGH THE SERVICES. THESE LIMITATIONS APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.<\/span><\/span><\/p>\n<\/div><\/div><div  class=\"vc_toggle vc_toggle_simple vc_toggle_color_default  vc_toggle_size_sm\"><div class=\"vc_toggle_title\"><h3 style=\"font-size: 16px;color: #666666;text-align: left\" class=\"vc_custom_heading\"  >11. General Indemnities<\/h3><i class=\"vc_toggle_icon\"><\/i><\/div><div class=\"vc_toggle_content\"><p><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">11.1. User agrees that User will be responsible for User\u2019s use of the\u00a0Services, and User agrees to defend and indemnify Seensio and the\u00a0Affiliated Parties\u00a0from and against every claim, liability, damage, loss, and expense, including reasonable attorneys\u2019 fees and costs, arising out of or in any way connected with: (a) User\u2019s access to, use of, or alleged use of the\u00a0Services; (b) User\u2019s violation of any part of the\u00a0Seensio Terms, any representation, warranty, or agreement referenced in the\u00a0Seensio Terms, or any applicable law or regulation; (c) User\u2019s actual or alleged violation of any third-party right, including any intellectual property right, publicity or privacy right, property right, or confidentiality obligation; or (d) any\u00a0Dispute\u00a0or issue between User and any third party. Seensio reserves the right, at Seensio\u2019s own cost, to take on the exclusive defense and control of any matter subject to indemnification by User (without limiting User\u2019s indemnification obligations with respect to that matter), and in that case, User agrees to cooperate with Seensio defense of that claim.<\/span><\/p>\n<\/div><\/div><div  class=\"vc_toggle vc_toggle_simple vc_toggle_color_default  vc_toggle_size_sm\"><div class=\"vc_toggle_title\"><h3 style=\"font-size: 16px;color: #666666;text-align: left\" class=\"vc_custom_heading\"  >12. Miscellaneous Term<\/h3><i class=\"vc_toggle_icon\"><\/i><\/div><div class=\"vc_toggle_content\"><p><span style=\"font-size: 14px; color: #666666;\"><span style=\"font-weight: 400;\">12.1. These\u00a0User Terms, together with the other\u00a0Seensio Terms, make up the entire agreement between User and Seensio regarding the\u00a0Services. User may not assign the\u00a0Seensio Terms\u00a0or User\u2019s rights under the Seensio Terms, by operation of law or otherwise, without Seensio\u2019s prior written consent. Seensio may assign the\u00a0Seensio Terms\u00a0at any time to anyone without notice or consent. This agreement is binding on and inures to the benefit of Seensio\u2019s and User\u2019s respective successors and assigns. If any part of the\u00a0Seensio Terms\u00a0is held to be invalid or unenforceable, the unenforceable part will be given effect to the greatest extent possible (or, if it cannot legally be given any effect, will be severed from the\u00a0Seensio Terms), and the remaining parts will remain in full force and effect. Users may creatre wearables and names using the Seensio logo and name on the Seensio platform, provided that they don\u2019t violate the platform\u2019s Content Policy and Terms of Use. As far as the jk Technologies concerned, you are not prevented from monetizing or obatining profits from the sale of saird wearables or user names. The NFT must be unique in design.<\/span><\/p>\n<p><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">jK Technologies has the right to deny the use of Seensio name and logo at its sole discretion in any case and at any time.<\/span><\/p>\n<\/div><\/div><div  class=\"vc_toggle vc_toggle_simple vc_toggle_color_default  vc_toggle_size_sm\"><div class=\"vc_toggle_title\"><h3 style=\"font-size: 16px;color: #666666;text-align: left\" class=\"vc_custom_heading\"  >4. Subject to these terms you can use the name \u201cSeensio\u201d to promote your asset(s) or wearables as long it doesn\u2019t confuse consumers and as long as it is not used as the name of an app or any kind of merchandise or product. You are allowed to resize the logo as long as you do not modify the proportions. JK TECHNOLGIES HAS THE RIGHT TO DECIDE (IN THEIR SOLE DISCRETION) WHETHER THE USE IS ACCEPTABLE.<\/span><\/p>\n<p><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">YOU MUST NOT USE SEENSIO NAME OR LOGO IN ANY MANNER THAT IS LIKELY TO HAVE AN ADVERSE EFFECT ON THE REPUTATION OF SEENSIO (AS THE JK TECHNOLGIES MAY DETERMINE IN THEIR SOLE DISCRETION). Definitions<\/h3><i class=\"vc_toggle_icon\"><\/i><\/div><div class=\"vc_toggle_content\"><p><span style=\"font-size: 14px; color: #666666;\"><span style=\"font-weight: 400;\">1.1.<\/span><b> &#8220;Content&#8221;<\/b><span style=\"font-weight: 400;\"> shall mean any work of authorship, creative works, graphics, images, textures, photos, logos, video, audio, text and interactive features, including without limitation NFTs, submitted by the Users of Seensio.<\/span><\/span><\/p>\n<p><span style=\"font-size: 14px; color: #666666;\"><span style=\"font-weight: 400;\">1.2. <\/span><b>&#8220;Intellectual Property Rights&#8221;<\/b><span style=\"font-weight: 400;\"> shall mean rights in, arising out of, or associated with intellectual property in any jurisdiction, including without limitation rights in or arising out of, or associated with (1) copyrights, mask work rights, and other rights in published and unpublished works of authorship, including without limitation computer programs, databases, graphics, user interfaces, and similar works; (2) patents, design rights, and other rights in inventions and discoveries, including without limitation articles of manufacture, business methods, compositions of matter, improvements, machines, methods, and processes; (3) trademarks, service marks, trade dress and other logos and similar indications of origin of, or association with, a group, business, good, product, or service; (4) trade secrets and other information that is not generally known or readily ascertainable by third parties through proper means, whether tangible or intangible, including without limitation algorithms, customer lists, ideas, designs, formulas, know-how, source code, methods, processes, programs, prototypes, systems, and techniques; (5) a person&#8217;s name, voice, signature, photograph, or likeness, including without limitation rights of personality, privacy, and publicity; (6) attribution and integrity and other so-called moral rights of an author; (7) internet domain names; (8) data and databases; and (9) similar proprietary rights arising under the laws of any jurisdiction<\/span><\/span><\/p>\n<p><span style=\"font-size: 14px; color: #666666;\"><span style=\"font-weight: 400;\">1.3. <\/span><b>&#8220;NFT&#8221;<\/b><span style=\"font-weight: 400;\"> means non-fungible token, including, place, Wearables and any other kind of NFTs available in Seensio.<\/span><\/span><\/p>\n<\/div><\/div><div  class=\"vc_toggle vc_toggle_simple vc_toggle_color_default  vc_toggle_size_sm\"><div class=\"vc_toggle_title\"><h3 style=\"font-size: 16px;color: #666666;text-align: left\" class=\"vc_custom_heading\"  >2. Prohibited Content<\/h3><i class=\"vc_toggle_icon\"><\/i><\/div><div class=\"vc_toggle_content\"><p><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">All Content uploaded, posted, created, displayed, transmitted or made available by the User through the tools must not include:<\/span><\/p>\n<p><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">2.1. Content involving illegality, such as piracy, criminal activity, terrorism, obscenity, child pornography, gambling (subject to Section 3 below), and illegal drug use.<\/span><\/p>\n<p><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">2.2. Content infringing third party Intellectual Property Rights.<\/span><\/p>\n<p><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">2.3. Cruel or hateful Content that could harm, harass, promote or condone violence against, or that is primarily intended to incite hatred of, animals, or individuals or groups based on race or ethnic origin, religion, nationality, disability, gender, age, veteran status, or sexual orientation\/gender identity.<\/span><\/p>\n<p><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">2.4. Content that is libelous, false, inaccurate, misleading, or invades another person&#8217;s privacy.<\/span><\/p>\n<p><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">2.5. Content that breaches the Privacy Policy or applicable data privacy laws.<\/span><\/p>\n<p><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">2.6. Content that promotes or could be construed as primarily intended to evade the limitations above.<\/span><\/p>\n<\/div><\/div><div  class=\"vc_toggle vc_toggle_simple vc_toggle_color_default  vc_toggle_size_sm\"><div class=\"vc_toggle_title\"><h3 style=\"font-size: 16px;color: #666666;text-align: left\" class=\"vc_custom_heading\"  >3. You acknowledge that the platform does not guarantee the accuracy of information submitted by any user of the platform, nor any identity information about any user. To keep it secure, some uses of Sio Coin are not permitted, including:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">Using third-party services to sell, trade, or give away Sio Coin. These does not apply to Seensio gift cards.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">Promotional codes that falsely appear to be offered by Seensio itself<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">Inappropriate use of the group payout system included offering payment in Sio Coin for acting as a model for assets, joining groups, referring members, or role-playing in experiences.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">You also may not use third-party services or products to sell either directly or as a bundle: in-experience items, exclusive features, or other in-experience enhancements.<\/span><\/p>\n<p><span style=\"font-weight: 400; font-size: 14px; color: #666666;\">We also don\u2019t allow using Seensio to solicit donations for an external charitable cause.
